Supplemental Terms

1. Acceptance and relationship to Apple’s EULA

These Supplemental Terms (“Terms”) are an agreement between you and Goldenberg Tech Advisors LLC (“we,” “us”) and apply in addition to Apple’s Licensed Application End User License Agreement (“Standard EULA”). The Standard EULA governs your license to download and use the Meld Club application (the “App”). These Terms do not replace or modify the Standard EULA. If these Terms conflict with the Standard EULA regarding your license to the App, the Standard EULA controls.

By using the App or purchasing Meld Club Plus, you agree to the Standard EULA, these Terms, and our Privacy Policy. If you do not agree, do not use the App or purchase a subscription.

2. Supplemental scope

These Terms govern Meld Club Plus subscriptions, acceptable use, support, and other matters described below that supplement the Standard EULA. They do not grant a separate license to the App or change any right or obligation in the Standard EULA.

3. Meld Club Plus subscriptions

The App is free to download. Its interactive lesson, Rookie computer opponents, optional coaching, basic local statistics, and one new solo table each day are available without a subscription. Meld Club Plus is an optional auto-renewable subscription that, while active, removes the daily new-table limit and unlocks Club and Expert computer opponents, complete saved house-rule presets, advanced game history, streaks, records and achievements, and all premium table and playing-card collections.

• Pricing. Meld Club Plus is offered monthly and annually. Intended US pricing is $5.99/month and $39.99/year; actual prices are shown in the App before purchase and may vary by region and over time.
• Billing & auto-renewal. Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically for the same period unless you cancel at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the period ends.
• Managing & canceling. You can manage or cancel your subscription in your Apple ID account settings (Settings → your name → Subscriptions). Canceling stops future renewals; you keep Plus until the end of the paid period.
• Restoring access. If an active purchase is not recognized, use the Restore option on the membership screen while signed in with the Apple ID used to subscribe.
• Refunds. Purchases are handled by Apple and are subject to Apple's refund policies. We do not process payments and generally cannot issue refunds directly.
• Free trials or offers, if any, are disclosed at the point of purchase; any unused portion of a free period is forfeited when you buy a subscription.

4. Acceptable use

You agree not to: (a) copy, modify, or create derivative works of the App; (b) reverse engineer, decompile, or disassemble the App except to the extent permitted by law; (c) rent, lease, lend, sell, or sublicense the App; (d) circumvent the free-play limits, subscription controls, or any security features; or (e) use the App in any unlawful manner.

5. Intellectual property

The App, including its software, artwork, text, and the Meld Club name and logo, is owned by us or our licensors and is protected by intellectual-property laws. Hand & Foot Canasta is a traditional, public-domain card game; the game rules are not owned by us, but our specific implementation, design, and branding are. All rights not expressly granted are reserved.

6. Your content

The App is a solo game and does not host user accounts or publish user content. Any feedback you send us is voluntary, and you grant us permission to use it to improve the App without obligation to you.

7. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid us for the App in the 12 months before the claim, or USD 50 if you paid nothing. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Apple Standard EULA

Apple’s Standard EULA, rather than these Supplemental Terms, provides the license for the App and addresses the license scope, maintenance and support, warranties, product claims, intellectual-property claims, legal compliance, and Apple’s third-party-beneficiary rights. We incorporate the Standard EULA by reference and do not replace it with a custom license agreement.

11. Termination

These Terms apply until terminated. We may terminate your access to services we provide if you fail to comply with these Terms, subject to applicable law. Your license to the App is governed by the Standard EULA. Sections that by their nature should survive termination, including intellectual property, disclaimers, and limitation of liability, will survive.

12. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws rules, except that this choice does not deprive you of protections under the mandatory consumer law of your place of residence. You and we agree that the state and federal courts located in Delaware will have exclusive jurisdiction over any dispute arising from these Terms or the App, except where applicable law gives you the right to bring a claim in the courts of your place of residence.

13. Changes to these terms

We may update these Supplemental Terms as the App evolves. When we do, we will update the “Last updated” date above. Your continued use of the App after changes take effect means you accept the revised Terms. Updates to these Terms do not modify Apple’s Standard EULA.
